While Shirley's brother was trying to remove Shirley and Patrick's personal and business property from the premises, Mr. Raahauge stopped him and only allowed removal of the business files and records. In a rent dispute, Mr. Raahauge seized all of the equipment and remaining property of Gameland Kennels and Patrick Callaghan Enterprises, as well as several items of Shirley and Patrick's personal property that was on the premises.
We know that the Three-Day Notice of Quit is not legally enforceable. It was not properly served, the death of Patrick Callaghan is not sufficient cause to terminate the lease, law requires we have 5 days to answer any notice, we cannot be required to remove leasehold improvements that were constructed with the permission of the Lessor, and Mike Raahauge has no claim on the personal property of Shirley Callaghan or the business property of Patrick Callaghan Enterprises or Gameland Kennels without compensation to Shirley.
